      1. These terms and conditions (Terms) apply when you use this website, GoodwillChoice.com.au (Website).
      2. You agree to be bound by these Terms which form a binding contractual agreement between you and us, Goodwill Choice Pty Ltd ABN 47 628 902 634 (Goodwill Choice, our, we or us).
      3. If you don’t agree to these Terms, you must refrain from using the Website.
      4. We may change these Terms at any time by updating this page of the Website, and your continued use of the Website following such an update will represent an agreement by you to be bound by the Terms as amended.
  2. ACCESS AND USE OF THE WEBSITE

You must only use the Website in accordance with these Terms and any applicable laws, and must ensure that your employees, sub-contractors and any other agents who use or access the Website comply with the Terms and any applicable laws.

  1. YOUR OBLIGATIONS

You must not:

      1. copy, mirror, reproduce, translate, adapt, vary, modify, sell, decipher or decompile any part or aspect of the Website without the express consent of Goodwill Choice;
      2. use the Website for any purpose other than the purposes of browsing, selecting or purchasing goods;
      3. engage in any communication in connection with the Website that is harmful, discriminatory, abusive, defamatory or contains maliciously false implications, or any offensive or explicit material;
      4. use, or attempt to use, the Website in a manner that is illegal or fraudulent or facilitates illegal or fraudulent activity;
      5. use, or attempt to use, the Website in a manner that may interfere with, disrupt or create undue burden on the Website or the servers or networks that host the Website;
      6. use the Website with the assistance of any automated scripting tool or software;
      7. act in a way that may diminish or adversely impact the reputation of Goodwill Choice, including by linking to the Website on any other website; and
      8. attempt to breach the security of the Website, or otherwise interfere with the normal functions of the Website, including by:
        1. gaining unauthorised access to Website accounts or data;
        2. scanning, probing or testing the Website for security vulnerabilities;
        3. overloading, flooding, mailbombing, crashing or submitting a virus to the Website; or
        4. instigate or participate in a denial-of-service attack against the Website.
  1. INFORMATION ON THE WEBSITE, NO ADVICE
      1. While we make every effort to ensure that the information on the Website is as up-to-date and accurate as possible, you acknowledge and agree that we do not (to the maximum extent permitted by law) guarantee that:
        1. the Website will be free from errors or defects;
        2. the Website will be accessible at all times;
        3. messages sent through the Website will be delivered promptly, or delivered at all;

You must not otherwise reproduce, transmit, adapt, distribute, sell, modify or publish the Website or any Website Content without prior written consent from Goodwill Choice or as permitted by law.

      1. Goodwill Choice works with partners and affiliates (Affiliates) whose websites are linked to the Website, and whose products are listed on the Website.
      2. Goodwill Choice has no control over the content or quality of the products or services provided by Affiliates and we make no guarantees about those products or services.
      3. Affiliates are separate entities from Goodwill Choice and Goodwill Choice does not represent or otherwise act on behalf of any Affiliate.

      1. The Website may contain links to other websites that are not our responsibility. We have no control over the content of the linked websites and we are not responsible for it.
      2. Links to third party websites, including Affiliate websites, are provided for convenience and may not be maintained or remain current. We do not endorse and are not responsible for the content on third party websites and have no control over or rights in them

Goodwill Choice does not accept responsibility for loss or damage to computer systems, mobile phones or other electronic devices arising in connection with use of the Website. You should take your own precautions to ensure that the process that you employ for accessing the Website does not expose you to risk of viruses, malicious computer code or other forms of interference.

If you become aware of misuse of the Website by any person, any errors in the material on the Website or any difficulty in accessing or using the Website, please contact us immediately using the contact details or form provided on our Website.

We make no warranties or representations about this Website or any of its content and will not be responsible to you or any third party for any direct or consequential loss suffered in connection with the use of this Website. To the maximum extent permitted by law, we exclude any liability that may arise due to your use of our Website and/or the information or materials contained on it. You agree to indemnify us for any loss or liability arising out of your use of this Website.

  1. GENERAL
    1. GOVERNING LAW AND JURISDICTION

This agreement is governed by the law applying in Victoria, Australia. Each party irrevocably submits to the exclusive jurisdiction of the courts of Victoria, Australia and courts of appeal from them in respect of any proceedings arising out of or in connection with this agreement. Each party irrevocably waives any objection to the venue of any legal process on the basis that the process has been brought in an inconvenient forum.

    1. WAIVER

No party to this agreement may rely on the words or conduct of any other party as a waiver of any right unless the waiver is in writing and signed by the party granting the waiver.

    1. SEVERANCE

Any term of this agreement which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity and enforceability of the remainder of this agreement is not limited or otherwise affected.

    1. JOINT AND SEVERAL LIABILITY

An obligation or a liability assumed by, or a right conferred on, two or more persons binds or benefits them jointly and severally.

    1. ASSIGNMENT

A party cannot assign, novate or otherwise transfer any of its rights or obligations under this agreement without the prior written consent of the other party.

    1. ENTIRE AGREEMENT

This agreement embodies the entire agreement between the parties and supersedes any prior negotiation, conduct, arrangement, understanding or agreement, express or implied, in relation to the subject matter of this agreement.

    1. INTERPRETATION
      1. (singular and plural) words in the singular includes the plural (and vice versa);
      2. (gender) words indicating a gender includes the corresponding words of any other gender;
      3. (defined terms) if a word or phrase is given a defined meaning, any other part of speech or grammatical form of that word or phrase has a corresponding meaning;
      4. (person) a reference to "person" or "you" includes an individual, the estate of an individual, a corporation, an authority, an association, consortium or joint venture (whether incorporated or unincorporated), a partnership, a trust and any other entity;
      5. (party) a reference to a party includes that party's executors, administrators, successors and permitted assigns, including persons taking by way of novation and, in the case of a trustee, includes any substituted or additional trustee;
      6. (this agreement) a reference to a party, clause, paragraph, schedule, exhibit, attachment or annexure is a reference to a party, clause, paragraph, schedule, exhibit, attachment or annexure to or of this agreement, and a reference to this agreement includes all schedules, exhibits, attachments and annexures to it;
      7. (document) a reference to a document (including this agreement) is to that document as varied, novated, ratified or replaced from time to time;
      8. (headings) headings and words in bold type are for convenience only and do not affect interpretation;
      9. (includes) the word "includes" and similar words in any form is not a word of limitation; and
      10. (adverse interpretation) no provision of this agreement will be interpreted adversely to a party because that party was responsible for the preparation of this agreement or that provision.

 

GOODWILL CHOICE LOTTO

The Goodwill Choice Lotto complies with each Australian State and Territory’s legislation under the relevant Trade Promotion Act.

 

Goodwill Choice seeks to run the lotto once a month, the finish day and time of each draw is shown on the app. Goodwill Choice and possibly sponsors contribute money to the prize pool amount. The Goodwill Lotto’s prize amount may change at any time at our sole discretion

 

Goodwill lotto tickets can not be purchased. All Customers (13+ age) have the option to obtain free tickets for the Goodwill Lotto using Goodwill Points. They have the opportunity to participate in the Goodwill Lotto only by redeeming free Goodwill Points derived when they purchase & scan a goodwill associated product.They will be assigned a unique ticket number for each ticket they obtain.

 

Draws are conducted monthly by an authorised independent third-party using computerised devices to randomly pick numbers. At present one winner is chosen but later on it may be split depending on the pool size. Winners will be notified on the app and also contacted. If you win a Goodwill Lotto, then you will be able to claim 50% of the total prize amount.The remaining 50% must be donated to a charity of your choice using the Goodwill Choice Mobile Application within two (2) weeks of winning the Goodwill Lotto.If you do not donate the remaining 50% of the prize amount within two (2) weeks of winning, the proceeds will be donated to the charity of our choice. The app shows current & past winners and where they donated their 50% too.

 

By particapting, customers agree to these official rules.

 

Apple and Google are not sponsors of the Goodwill Choice Lotto, nor do they endorse this service or sponsor any prize redemptions.

 

 

 

Goodwill Choice Mobile Application - Terms and Conditions

 

The Goodwill Choice Mobile Application is owned and operated by Goodwill Choice Pty Ltd (628 902 634) (referred to as we/us/our).

These terms and conditions (Terms) govern the access and use of the Goodwill Choice Mobile Application. Please read all of the important information below. If you do not agree to any of these terms and conditions, please do not continue to use this application.

Apple and Google terms and conditions

These Terms supplement and incorporate the Apple, Inc Terms and Conditions including the Licenced Application End User Licence Agreement provided therein and the Android, Google Inc. Terms and Conditions including the License Agreement and Terms of Application.

In the event of inconsistencies between these Terms and the Apple, Inc Terms and Conditions or the Android, Google Inc Terms and Conditions, this Terms will prevail to the fullest extent possible.

Eligibility

The Goodwill Choice Mobile Application can be used by persons aged thirteen (13) years or older. Further, you must be an Australian resident to access and use the Goodwill Choice Mobile Application. Do not register if you are under 13 years of age or if you are not an Australian citizen. 

User registration

You must register on the Goodwill Choice Mobile Application to access and use the application. If you do not register, you will not be able to access all features on the application.

We collect the following information when you register with us:

  1. Your first and last name;
  2. Your email address;
  3. Your mobile number; and
  4. Your birth date.

Please note that you cannot change your birth date at a later stage without contacting our support team. It is your responsibility to ensure that the details you provide are correct. Please check any details carefully before submitting them.

You can also register on the Goodwill Choice Mobile Application using Facebook, Google and your Apple ID.  

How do we operate?

We have established commercial relationships with various products and services providers so that every time when you purchase a product or service from our associates, you earn money and points (Goodwill Points). You can then donate that money to a charity of your choice.

You can also donate using the Goodwill Choice Mobile Application and even support crowdfunding goals.

We have established a simple three-step process for you to earn money and Goodwill Points.

First, purchase a product or service from one of our associates and look for our label as shown below (Goodwill Choice Label)

 

 

Second, scratch back the label and scan the code to earn money and Goodwill Points. Finally, the money earned and accumulated can be donated to a charity of your choice and the Goodwill Points earned and accumulated can be redeemed to receive rewards via our store (Goodwill Store).

Online Sales, affiliate merchants and no label scanning requirement

You also have the option of purchasing products from our affiliated and associated retailers on the Goodwill Choice Mobile Application.

Products from our affiliated retailers do not carry the Goodwill Choice label and Goodwill Points and donation money are automatically added to your account upon a successful purchase.

It is important to note that we do not hold on to any inventory and any purchase that takes place will be between yourself and the retailers.

Some of our retailers will work with us on affiliate marketing basis. When you follow an affiliate marketing link on the Goodwill Choice Mobile Application, you will be redirected to that retailer’s website. When you make a successful purchase on the retailer’s website, the retailer will pay us a percentage of the purchase as commissions. These commissions will be used by us to cover overhead costs including donation money passed onto customers to donate to charities.

Our relationships with affiliated and associated members are regulated by affiliate networks. Affiliate networks work with retailers to track purchases by consumers and forward that information to us. Once the information has been forwarded to us, goodwill points and goodwill donation money will be added to your account on the Goodwill Choice Mobile Application.

Tracking and collection of purchase information is not under our control, and we have no say over it. As such, we cannot be held responsible if the purchase information has not been passed on to us and consequently not added to your account on the Goodwill Choice Mobile Application. If you find out that the purchase information has not been added to your account, then please contact us as soon as practicable and we will conduct the necessary investigations.

By virtue of the involvement of various parties as stated above, you may receive your Goodwill Points and/or donation money after we have been notified of the purchase which may take few days to weeks. We will endeavour to send you an email informing you of the points and/or donation money received.

Finally, the products sold by our affiliated and associated retailers are the sole responsibility of that retailer. As such, if you encounter any issues with the products, payments or delivery, we recommend that you contact the retailer and not us.

Goodwill points

The Goodwill Points do not have any real monetary value outside the Goodwill Choice Mobile Application and can only be used to claim rewards via the Goodwill Store. The Goodwill Points cannot be transferred to or shared with a third party and are for your personal use only. Further, the Goodwill points do not expire and can be used anytime.

You may at times be able to claim bonus Goodwill Points when you purchase a product or service as some labels may include bonus points.

Money

The money that you have earned and accumulated through the Goodwill Choice Mobile Application can only be donated to a charity of your choice.  This means that you cannot transfer it to your bank account or to a third party’s bank account. Further, all proceeds are forwarded to the charity without any deductions.

We will forward your donation to your nominated charity in your name. This will allow you to receive a tax-deductible receipt if the charity is a registered Deductible Gift Recipient and the amount donated if more than $2.00.

The money that you have earned has an expiry date which is stated underneath the amount earned inthe scan history. If you do not donate the money before the expiry date, the money will be automatically donated the ‘default charity’. The ‘default charity’ is chosen by the providers of products or services when they get labels from us.   

For technical reasons, there is often a short delay in remitting the donation to the relevant charity.

Charity

We provide you with a platform to connect with various charities. However, we cannot provide any warranties or guarantees in relation their activities and how they use the funds. We cannot guarantee that the content and information surrounding the charities would be 100% factually correct. If you have any concerns in relation to the use of donation by a charity, then we recommend that you contact the charity before donating.

Badges

We recognise your efforts by rewarding you with badges as you hit various milestones.

To qualify for a badge, you must donate a minimum amount. However, you will not receive a badge unless the community meets the goal amount.  Further, all money donated towards a goal will go to the charity irrespective of you receiving a badge or not.

Goodwill store

A person under the age of 18 will not be able to purchase restricted goods, such as alcohol, from the Goodwill Store.  

Further, limits will apply to the number of goods you can purchase at a time. Any offer by you to purchase the goods on the Goodwill Store is subject to the availability of the goods in question. If a good is not in stock or readily available, the entire offer will be considered as a null and void and your Goodwill Points will be refunded to you.  

To the extent permissible by law, you will be liable for the costs of returning any goods. If the goods are deemed to be damaged in transit, then you should contact Australia Post. 

 

Cashbacks

 

You receive Goodwill Points on purchases you make, and each Goodwill Point is worth 10 cents thus you can redeem all or some of your Goodwill Points in the Goodwill Redeem Store on the App. After you submit a request for Cashback we get notified and within a few days or so you will receive an email from us to confirm the transaction and once we verify your details and receive your banking eft details we will process the payment.

NOTE - when redeeming items on the app it will ask for your address - even for cashbacks & cash prizes please include this even though we are not sending the cash to you in the mail (it will be an eft to you).

 

Goodwill lotto

By participating customers agree to the above rules.

APPLE, INC, (“APPLE”) is not a sponsor of the Goodwill Choice Lotto, nor do they endorse or sponsor any prize redemptions.

 

 

Acceptable use

When you register with us, we grant you a limited, non-exclusive, personal, non-transferrable, non-shareable, non-sublicensable, revocable licence to access and use the Goodwill Choice Mobile Application pursuant to these Terms and any additional terms and conditions set forth by us from time to time.

You can download the Goodwill Choice Mobile Application through Apple Store or Google Play on your Android Phone, iPhone or iPad for free. You can access and use the Goodwill Choice Mobile Application on only 1 device at a time.

You can use the Goodwill Choice Mobile Application only for purchasing and scanning the products or services and for earning, donating and or redeeming money and Goodwill Points. You cannot use the Goodwill Choice Mobile Application for any other purpose including any illegal activities.

Restricted activities

You agree not to:

  1. Reverse engineer, extract, decompile, modify, create derivative works of, or otherwise amend the Goodwill Choice Mobile Application;
  2. Evade any security feature or functionality of the Goodwill Choice Mobile Application;
  3. Permit any third party to access or use the Goodwill Choice Mobile Application;
  4. Use any code or application that interferes with the working of the Goodwill Choice Mobile Application;
  5. Use the Goodwill Choice Mobile Application in any manner which is contrary to an Australian law;
  6. Scan labels without making a legitimate purchase;
  7. Provide false information;
  8. Apply labels to other products or switch the labels of the products; and
  9. Onsell any information obtained from this Goodwill Choice Mobile Application, use any data mining robots or other extraction tools or metatag or mirror the Goodwill Choice Mobile Application.

Payment

If you wish to donate out of your own pocket, then you can do so using the Goodwill Choice Mobile Application.

We use the Stripe payment gateway to allow you to donate. The Stripe payment gateway accepts payment via Visa, Mastercard, American Express, Discover, Diner Club and JCB. We reserve the right to change our mode of accepting donations at any time.

To the extent permitted by law, we will not be held liable and responsible for any damages or consequential loss (whether direct or indirect) suffered by you as a result of any credit card fraud or use of the Stripe payment gateway.

We will not be held liable or responsible for any additional charges imposed by your credit card provider or bank.

As payments are processed through Stripe, we do not hold your financial information at any time. If you have any concerns regarding the use, disclosure or deletion of your financial information, then please review Stripe’s privacy policy.

Tax receipts

It is the duty of the charity to issue tax receipts to you for your donation.

There may be delays in receiving tax receipts due to the time taken to process and transfer donations from our systems to the charity.

However, Goodwill Choice can issue you a donation receipt if agreed to by the endorsed Deductible Gift Recipient (DGR) charity. Under section 30-15 the ATO accepts receipts from third parties as evidence of a gift to a DGR if the receipt identifies the members name, the date of donation, the amount, and a description of the transaction: donation to xxxxx (charity). Goodwill Choice will issue this to you if the DGR gives Goodwill Choice approval.

Intellectual Property Rights

We own all intellectual property rights (including but not limited to copyright, patents, trade marks (whether registered or unregistered)) in the Goodwill Choice Mobile Application and its materials, information and content. You must not reproduce, store, adapt, distribute, display, publish or create similar works from them.

When you download and create an account on the Goodwill Choice Mobile Application, we will grant you a revocable, non-exclusive, non-transferrable, non-shareable, royalty-free and non-sublicensable licence in the content of the Goodwill Choice Mobile Application to you.

This abovementioned licence is for your personal use only and only for the purposes of using the functionalities of the Goodwill Choice Mobile Application. You cannot sub-license it to a third-party.

No licence is granted to you either expressly or impliedly in the trade marks, names or logos of the Goodwill Choice Mobile Application.

Social media accounts

From time-to-time, we may operate accounts on various social media accounts such as Facebook, Twitter and Instagram. You can join our social media to get latest updates about our business and connect with other members.

You must be respectful and courteous in your interactions on social media accounts. You must not make any vile, racist, sexist, discriminatory or hateful comments on our social media pages. If you make inappropriate comments on our social media pages, then your access to our social media pages and the Goodwill Choice Mobile Application will be terminated.  

Data security

We will adopt reasonable cybersecurity practices to safeguard your personal information against cyber-attacks, data breaches and hacks. This includes but is not limited to storing the personal information on secure encrypted servers.

Data sharing

You agree for us to share your name, email address, contact details and donation amounts with the charity of your choice for the purpose of obtaining tax deductive receipts only. They are not shared for any marketing and or advertising activities. Should you receive any marketing or advertising material from the charity, then please contact us immediately.

The Goodwill Choice Mobile Applications uses functions of various social media platforms. Your personal details will be shared with the social media platform when you use the “share” function to select the social media platform. We have no influence or control over the data that has been shared with the social media platform. If you have any concerns regarding the use, disclosure or deletion of the personal information by a social media platform, kindly review the social media platform’s privacy policy before sharing.

We may from time-to-time publish your activities in the “activity feed” on the “what’s happening” section of the Goodwill Choice Mobile Application. Your details may also appear in the “leader board” section of the Goodwill Choice Mobile Application. If you do not want your details to be published on the “activity feed” and “leader board”, then you can disable these options in the privacy settings of the Goodwill Choice Mobile Application.

Marketing

By registering with us, you agree for us to send you our newsletter and occasional updates or offers. You can opt-out of receiving any marketing and advertising materials at any time.

Suspension

If you are in breach of these Terms and if the breach is not remedied within a reasonable time period, we reserve the right to suspend your access and use of the Goodwill Choice Mobile Application.

Terminate

We reserve the right to terminate your access and use of the Goodwill Choice Mobile Application if you are in a serious breach of the Terms or if you repeatedly breach these Terms.

Testimonials

Any review or other matter that could be regarded as a testimonial or endorsement about Goodwill Choice Mobile Application does not constitute a guarantee, warranty, or prediction regarding the outcome of any use of Goodwill Choice Mobile Application and you acknowledge that testimonials represent the anecdotal experience of individual consumers.

Third Party Beneficiary

Apple and Apple’s subsidiaries and Google and Google subsidiaries are third party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple and Google will have the right to enforce these Terms against you as a third-party beneficiary thereof.

Limitation of liability

We will not be liable to you for any special, indirect, consequential or punitive damages, including but not limited to loss of profits, loss of business opportunities, or loss of goodwill, arising out of or related to the use of the Goodwill Choice Mobile Application, even if advised of the possibility of such damages.

 

 

Availability of the application

From time to time, down-time, either scheduled or unscheduled, may occur. We will endeavour to work within reason to ensure the amount of down-time is limited and will not be held liable for the consequences of any down-time.

Variations

We may vary these Terms by giving you written notice ant any time.

Jurisdiction and governing law

These Terms are governed by the laws of the State of Victoria, Australia.

Events which are out of control

We shall not be held liable and responsible for any delay in performance of our obligations under these Terms if the delay is caused by circumstances beyond our reasonable control.

Severability

Any provision in these Terms which is invalid or unenforceable in any jurisdiction is to be read down for the purposes of that jurisdiction, if possible, so as to be valid and enforceable. Otherwise, any provision in these Terms which is invalid or unenforceable in any jurisdiction is to be severed to the extent of the invalidity or unenforceability, without affecting the remaining provisions of these Terms.

Disclaimer
